Tresory
Terms of use
Note on this translation This translation is provided for information only. Only the German version is legally binding. Translations may contain errors. Go to the German version
1. Scope
These terms of use apply to the use of the Tresory app for iPhone and Android and the associated Cloud Vault. The provider is Neumeister Media. Full details can be found in the legal notice and at the end of these terms. By creating an account, you agree to these terms. How we handle your data is described in the privacy policy.
2. What Tresory is
Tresory is a vault for photos, videos and documents. You can protect files on your device, sync them between your devices with your account and back them up in a Cloud Vault. This includes shared albums, a chat with one-time photos and an optional subscription with more storage. We may further develop and change the scope of the app and occasionally remove features, provided this is reasonable for you.
3. Minimum age and account
You must be at least 13 years old. For children and young people under 16, we recommend use only in agreement with, and with the guidance and supervision of, a parent or guardian. If you are under 18, you use Tresory with the consent of your parents or guardians. This applies in particular to paid subscriptions.
For the account you need an email address that belongs to you and a password. Provide truthful information, keep your password and PIN secret and do not pass your account on to others. If you suspect that someone is misusing your account, change your password and contact us.
For shared albums and the chat you choose a username. It must not impersonate other people, be offensive or be misleading. We may ask you to change unsuitable names.
Tresory is intended for private use. Commercial use, for example as storage for customer data, is not intended.
4. Your content and your responsibility
Your photos, videos, documents and messages belong to you. We only receive the right to store and transmit them as required by the app's features, for example for syncing, shared albums and the chat.
You are responsible for your own content. You may not use Tresory for:
- content that is punishable under German law, in particular depictions of sexual abuse of children and young people, depictions of violence, incitement to hatred and threats,
- intimate recordings or photos of other people without their consent,
- harassment, insults, extortion, deception and spam, including in the chat,
- content to which you hold no rights, for example third-party works protected by copyright,
- attacks on the app or our servers and attempts to circumvent blocks or quotas.
Zero tolerance. We have zero tolerance for objectionable or unlawful content and for abusive behaviour, for example harassment, insults, threats and spam. We remove such content and may block the accounts responsible (see sections 5 and 6).
Shared albums. Whoever shares an album decides whom to invite and can revoke access at any time. Invited people can view the album's pictures and, depending on the setting, add their own. They can also keep copies on their device, which we cannot retrieve after access has been revoked. Only upload pictures to a shared album that you are allowed to share. This applies in particular to photos showing other people.
Protection features. Decoy PIN, decoy vault and intruder photo are intended for your own devices and your own PIN. The intruder photo is taken with the front camera after several wrong PIN entries and remains exclusively on your device. Do not use these features to monitor others against their will.
We do not read your private content on our own initiative and do not scan chats automatically. Despite our protection features, the recipient of a one-time photo you send in a chat can, for example, photograph it with a second camera. Only send to people you trust.
5. Reporting and blocking
You can block and report any person in the app. When you report someone, we store the last 20 messages of the conversation as evidence and review the case. You can also reach us at service@tresory.app. We usually review reported content within 24 hours. We remove content that violates these terms and block the accounts responsible. If there are indications of criminal offences, we may secure content and involve the competent authorities.
6. Suspension and termination
If you violate these terms, we remove the content concerned and may restrict features or suspend or delete your account. The measure we take depends on the severity of the violation. For serious violations, for example content that is punishable by law, we suspend immediately. We will inform you of the suspension and the reason, unless the law prevents this. You can object and explain your point of view by writing to us.
You can end your account yourself at any time. In the app, go to Settings › Account › Delete account. What is deleted is described on the page Delete account. You cancel an existing subscription separately in the App Store or on Google Play.
If we should in future no longer offer Tresory or parts of it, such as the Cloud Vault, we will announce this with reasonable notice, as a rule at least three months in advance, in the app and by email. During this time you can bring your files back to your device and back them up. If you have paid for a subscription for a period after the discontinuation, we will refund the amount for that time pro rata, as far as the store (App Store or Google Play) allows. Your statutory rights remain unaffected.
7. Storage and subscriptions
Every account has 1 GB of storage free of charge. More space is available with a subscription in the tiers Plus (50 GB), Pro (200 GB) and Max (1 TB), monthly or yearly. The store shows the current prices before purchase.
The purchase is handled via the Apple App Store or Google Play and is additionally subject to their terms. The subscription renews automatically for the same period unless you cancel it at least 24 hours before it expires. You can cancel and manage it at any time in the settings of your Apple or Google account. Payment, refunds and withdrawal are governed by the rules of the respective store and by law.
If a subscription expires, your files are kept. If your storage exceeds the smaller limit, you can no longer upload new files until there is space again.
8. Data loss, backup and availability
The Cloud Vault backs up your files on servers in Germany, but it is no substitute for your own backup. You should also keep important files in a second place.
We are not liable for lost data insofar as the loss is due to your own actions. This applies, for example, if you delete files or your account yourself, lose or reset a device, forget or pass on your password or PIN, or if third parties gain access to your account using your login details. We cannot restore files that are only on your device and have not yet been transferred to the Cloud Vault. Otherwise, section 9 applies. In cases of slight negligence, liability for data loss is limited to the effort that would have been required for restoration if you had made regular and proper backups. We strive for trouble-free operation. We cannot guarantee uninterrupted availability, for example during maintenance or outages of service providers.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body and health and under the German Product Liability Act. In cases of slight negligence, we are only liable if we breach an essential contractual obligation. These are obligations on whose fulfilment you may rely, such as the secure storage of your files. In that case, liability is limited to the typical damage foreseeable at the time the contract was concluded. Your statutory rights as a consumer remain unaffected.
10. Changes to these terms
We may change these terms, for example because of new features or a new legal situation. We will inform you of significant changes in the app or by email and, if necessary, obtain your renewed consent. If you do not agree, you can delete your account.
11. Applicable law and dispute resolution
German law applies. Mandatory consumer protection provisions of your country of residence remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
